PARKZILLA – TERMS OF USE

 

1. INTRODUCTION AND ACCEPTANCE OF THE TERMS OF USE
These Terms of Use (“Terms of Use”) constitute a binding legal agreement between you (whether individually or on behalf of an entity, “you” or “User”) and ParkZilla, Inc. (“ParkZilla”, “we”, “us”, or “our”), governing your access to and use of the Website located at https://www.parkzilla.com including any associated mobile Website’s, applications, or other platforms (collectively, the “Platform”). The term “User” refers to any individual or entity who accesses or uses the Platform in any capacity, including but not limited to as a Parking Host, Renter/Driver, Event Organizer, or Partners or Third Party Providers. Different or additional terms may apply depending on your User category and the specific services you use. These Terms of Use incorporate by reference all role based provisions, user policies posted on the Platform, and any separate agreements entered into between you and ParkZilla.

ParkZilla is incorporated in the United States, with its registered office located at 2196
Riesling Ave, Hanford, CA 93230. By accessing or using the Platform, you confirm that you
have read, understood, and agree to be bound by these Terms of Use. IF YOU DO NOT
AGREE TO THESE TERMS OF USE, YOU MAY NOT ACCESS OR USE THE
PLATFORM AND MUST IMMEDIATELY DISCONTINUE ANY USE.

 

User Category Definition: For the purposes of these Terms of Use, “User Category” refers
to the specific role under which you as a user engages with the ParkZilla Platform. Each User
Category carries distinct rights, responsibilities, and obligations based on the nature of the
user's activities on the platform.
 The following User Categories are recognized:
 Parking Host: An individual or entity offering one or more parking spaces for rent
via the Platform.
 Renter/Driver: An individual or entity seeking or booking parking services on the
Platform.
 Event Organizer: A user responsible for managing event-related parking logistics,
including space allocation, attendee instructions, and coordination with Hosts.
 Partners or Third Party Providers: A third-party service provider or technology
partner that integrates with the Platform or delivers services to ParkZilla users through
approved technology integrations.
By registering or using the Platform in one of these roles, you agree to the applicable
additional responsibilities as outlined throughout these Terms of Use. Where applicable, such
provisions are clearly identified in sections specific to each User Category. Supplemental
terms or guidelines that may be posted on the Platform periodically are hereby incorporated
by reference and form part of these Terms of Use.
Modifications: We reserve the right to update or modify these Terms of Use at our discretion,
for any reason, and at any time. If changes are made, the “Last Updated” date at the top of
this page will be revised accordingly. Your continued use of the Platform after such changes
constitutes your acceptance of the revised Terms of Use. It is your responsibility to review the
Terms of Use periodically for changes.

 

Access Restrictions: Access to the Platform may be restricted in certain jurisdictions. It is
your sole responsibility to ensure that your use of the Platform complies with all applicable
laws and regulations in your location. ParkZilla assumes no responsibility for use of the
Platform in regions where such access may be restricted or unlawful.
 

Age Limitation: This Platform is intended for users who are at least 18 years old. If you are
under the age of majority in your jurisdiction, you may only use the Platform under the
supervision and with the consent of a parent or legal guardian who agrees to be bound by
these Terms of Use on your behalf.

Service Fee and Payment Structure: ParkZilla may retain a service fee for each transaction
processed through the Platform. The amount and structure of this fee will be disclosed clearly
to users prior to completing any booking. By using the Platform, you acknowledge and agree
that this service fee may be deducted automatically from your payout or added to your total
payment amount, depending on your role and the nature of the transaction.
 

SMS Reservations: Users may initiate and complete parking reservations through ParkZilla's
SMS-based reservation system without creating an account. By submitting a booking request
via text message and clicking the link to confirm the reservation, you agree to be bound by
these Terms of Use and ParkZilla's Privacy Policy. SMS reservations may be subject to a
convenience fee that will be disclosed prior to finalizing the transaction.
 

Regulatory Use Notice: The ParkZilla platform is a general-purpose service and is not
specifically designed or certified to comply with any industry-specific regulations. Users are
solely responsible for ensuring their use of the Platform complies with any applicable
industry-specific regulations, including but not limited to the Health Insurance Portability and
Accountability Act (HIPAA), the Gramm-Leach-Bliley Act (GLBA), or the Federal
Information Security Management Act (FISMA).

By using the Platform, you acknowledge and agree that you are not relying on ParkZilla to
store, process, or transmit any data subject to these or similar regulatory regimes. This applies
to all users, including Parking Hosts, Renters/Drivers, Event Organizers, and Third-Party
Providers. If your use of the Platform, based on your role, would require compliance with
such laws or standards (e.g., HIPAA, GLBA, FISMA), you may not use ParkZilla for those
purposes.
